New York has some of the most significant short-term rental restrictions in the country, and the legal landscape for hosts here requires more careful navigation than in most other states. Since September 2023, New York City's Local Law 18 has required STR hosts to register with the city, be present during guest stays, and limits rentals to no more than two guests at a time. Products Liability. Welcome baskets, local food items, or consumable amenities that cause guest harm fall under products liability coverage. Lower frequency, but worth noting if you provide more than standard hotel-style toiletries.
What a BOP Does NOT Cover
The Structure Itself. BOP covers business personal property, not the building. A landlord policy, dwelling fire policy, or commercial property policy is required for the structure.
Guest Property Theft. AirCover handles some guest property claims. BOP does not cover property belonging to guests.
Intentional Acts. Deliberate damage by guests is excluded from BOP coverage.
Flood. Flood is excluded from standard BOP. Properties in the Hudson Valley, Long Island coastal areas, and parts of the Catskills near rivers have real flood exposure. Separate NFIP or private flood coverage is required.
STR Exclusions in Underlying Property Coverage. Many standard homeowner's policies exclude short-term rental activity. Verify your property coverage separately. In New York City, where Local Law 18 applies, verify that any rental activity complies with local law before assuming insurability.
New York-Specific Considerations
New York City's Local Law 18, which took effect September 5, 2023, effectively ended the market for unhosted entire-unit STRs in the five boroughs. Hosts who were renting investment properties as Airbnb units in Brooklyn, Queens, or Manhattan for less than 30 days are no longer legally operating if they are not present during the stay. Some hosts have pivoted to 30-plus-day rentals, which are legal under different rules. Others have exited the Airbnb model entirely.
