BOP Insurance for Amazon Sellers in New York: Coverage, Costs, and What It Covers

Amazon requires sellers who exceed $10,000 in monthly sales to carry at least $1 million in commercial general liability insurance and name Amazon.com Services LLC as an additional insured. A Business Owner's Policy (BOP) satisfies that requirement and adds property coverage for inventory and equipment in a single package. It does not cover product liability claims above your policy limits, and New York's litigation environment makes those limits worth thinking about seriously.

Quick Answer

Here is a rough estimate of what New York Amazon sellers pay for a BOP:

Annual RevenueEstimated Annual BOP Premium
Under $500K$1,000 to $2,000 per year
$500K to $2M$1,800 to $3,600 per year

New York is among the most expensive states in the country for BOP coverage. Higher claim costs, a dense litigation environment, and elevated commercial property values in and around New York City all push premiums up. Amazon's minimum requirement is $1 million per occurrence in general liability coverage, with Amazon.com Services LLC named as an additional insured on the policy.

What a BOP Covers

A BOP combines general liability and commercial property into one policy. For New York Amazon sellers, the relevant coverages are:

Third-Party Bodily Injury and Product Liability. If a customer is injured by a product you sold, your BOP's general liability component responds up to your policy limits. This is the coverage Amazon's insurance requirement is designed to ensure exists.

Property Damage from Your Products. If a product you sold damages a customer's property, the general liability component of your BOP covers that claim.

Business Personal Property. Office equipment, packaging supplies, and inventory stored at your own location are covered against fire, theft, and other named perils. Inventory at Amazon's FBA fulfillment centers is not included.

Business Interruption. If your office or warehouse suffers a covered loss and operations stop, business interruption coverage replaces lost income during the recovery period.

Advertising Injury. False advertising claims, including claims related to product listing content, are covered under the standard general liability component.

What a BOP Does NOT Cover

FBA Inventory at Amazon Warehouses. Inventory stored at Amazon fulfillment centers is managed under Amazon's FBA Inventory Reimbursement policy. Your BOP does not cover it. Only inventory at your own facility falls under your policy's property component.

Product Recall Costs. Standard BOP policies do not cover the costs of executing a product recall. That requires separate product recall insurance.

Intellectual Property Infringement. IP disputes, brand hijacking, and counterfeit complaints are not covered by a BOP. Your policy will not respond to defense costs in an IP claim.

Workers Compensation. New York law requires workers compensation for virtually all employers with employees. A BOP does not include WC. If you have any warehouse or office staff, you need a separate WC policy, typically through the New York State Insurance Fund or a private carrier.

Cyber Liability. The New York SHIELD Act requires businesses that own or license private information of New York residents to implement reasonable security safeguards and notify affected individuals after a breach. A BOP does not cover breach notification costs or regulatory response. A separate cyber liability policy handles those exposures.

New York-Specific Considerations

The New York City metro area has a large concentration of Amazon sellers, from solo operators running out of studio apartments to mid-size operations with small warehouses in the outer boroughs or northern New Jersey. The density of the market and the size of the customer base create meaningful product liability exposure.

New York's consumer protection laws are worth understanding. General Business Law Sections 349 and 350 prohibit deceptive acts and false advertising in the conduct of any business, trade, or commerce. These statutes have a private right of action, meaning individual consumers can sue under them, not just the state AG. Sellers with aggressive listing copy or marketing claims should be aware of this exposure. A BOP's advertising injury coverage may respond to some of these claims, but coverage will depend on the specific facts and your carrier's interpretation.

The SHIELD Act, New York's data security law, creates a separate obligation if you collect any private information from New York residents. That includes names combined with addresses, financial account numbers, or email addresses with passwords. If you run an email list or a side storefront, this is relevant. Your BOP does not cover SHIELD Act obligations.

Workers compensation through New York's system is mandatory. The state operates the New York State Insurance Fund (NYSIF) as the carrier of last resort, but private carriers also write WC in New York. Costs vary significantly based on payroll and job classifications.

Premium-wise, New York sellers should plan for premiums at the higher end of any national range. Litigation costs, commercial property values, and regulatory complexity all feed into carrier pricing in New York.

Frequently Asked Questions

Does a BOP satisfy Amazon's insurance requirement? Yes, in most cases. Amazon requires at least $1 million per occurrence in commercial general liability with Amazon.com Services LLC named as an additional insured. A BOP includes a GL component that meets those specifications. Before uploading your certificate to Seller Central, verify the additional insured language is correctly stated on the certificate.

Does the SHIELD Act affect my BOP? The SHIELD Act creates compliance and notification obligations if you suffer a data breach involving private information of New York residents. A standard BOP does not cover those costs. If you store any customer data outside of Amazon's systems, a cyber liability policy is the right tool for that exposure.

Is my FBA inventory covered under a BOP? No. FBA inventory at Amazon fulfillment centers falls under Amazon's FBA Inventory Reimbursement policy. Your BOP covers only inventory stored at a location you control.

Do I need workers compensation in New York? Yes, if you have employees. New York law requires WC coverage for virtually all employers. A BOP does not include workers compensation. You need a separate WC policy, through NYSIF or a private carrier.

What does a BOP cost for Amazon sellers in New York? New York sellers pay among the highest BOP premiums in the country. Estimated annual premiums range from $1,000 to $2,000 for sellers under $500K in revenue and $1,800 to $3,600 for sellers between $500K and $2M. Product category, on-site inventory value, and location within the state all affect where your premium falls in that range.
